1. Acceptance of Terms

By accessing or using TrendMonster ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Skillset Solutions FZ LLC.

2. Educational Software Only - Not Investment Advice

TrendMonster is educational software designed to teach systematic trading concepts.The Service is NOT investment advice, and Skillset Solutions FZ LLC is NOT:

• A registered investment adviser under federal or state securities laws
• A broker-dealer under SEC regulations
• A commodity trading advisor under CFTC regulations
• Providing personalized investment recommendations to you

The Service provides educational content about systematic trading strategies. All information is for educational purposes only and should not be construed as personalized investment advice.

3. Your Responsibility and Investment Decisions

YOU ARE SOLELY RESPONSIBLE FOR ALL INVESTMENT DECISIONS. You acknowledge and agree that:

• All investment decisions are made solely by you
• You are responsible for evaluating whether to follow any information provided by the Service
• We do not make investment decisions on your behalf
• You should consult with a qualified financial advisor before making investment decisions
• You have the financial resources to assume the risk of trading and potential losses

4. Risk Disclosure

TRADING INVOLVES SUBSTANTIAL RISK OF LOSS. You acknowledge that:

• You may lose your entire investment
• Past performance does not guarantee future results
• Hypothetical or backtested performance results have inherent limitations
• Historical backtested data represents perfect hindsight with zero slippage and no emotional errors
• Actual trading results may differ materially from backtested results
• Leveraged ETFs (such as TQQQ) can experience losses exceeding 80% in adverse market conditions
• Market conditions change, and strategies that worked historically may not work in the future
• Most traders lose money; you should not expect profits

Do not trade with money you cannot afford to lose.

5. Subscription Terms and Billing

Subscriptions are billed monthly at $500.00 per month. By subscribing, you agree that:

• Your subscription automatically renews each month unless cancelled
• You authorize Skillset Solutions FZ LLC to charge your payment method monthly
• You may cancel at any time through the Stripe Customer Portal (accessible from your account dashboard) or by contacting [email protected]
• Cancellations take effect at the end of the current billing period
• No refunds will be provided for partial months or unused time
• Prices are subject to change with 30 days advance notice

Note: The Stripe Customer Portal allows you to cancel your subscription, update your payment method, view billing history, and download invoices. You retain access to TrendMonster through the end of your current billing period after cancellation.

6. Service Access and Account

Upon subscription:

• Access to the TrendMonster dashboard is typically granted within 4 hours
• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate and complete information during registration
• You may not share your account access with others
• Access is removed when your subscription ends or is cancelled
• We reserve the right to suspend or terminate accounts that violate these Terms

7. No Guarantees or Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We make no guarantees regarding:

• Profitability or investment performance
• Accuracy, completeness, or timeliness of information
• Uninterrupted or error-free operation of the Service
• Results from using the Service
• Fitness for any particular purpose

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Skillset Solutions FZ LLC and its officers, directors, employees, and agents SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• This includes, but is not limited to, trading losses, lost profits, loss of data, or business interruption
• Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim
• These limitations apply even if we have been advised of the possibility of such damages

YOU ASSUME ALL RISK OF TRADING LOSSES. We are not responsible for any trading decisions you make or losses you incur.

9. Indemnification

You agree to indemnify, defend, and hold harmless Skillset Solutions FZ LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your investment decisions; (c) any trading losses you incur; (d) your violation of these Terms; or (e) your violation of any rights of another party.

10. Intellectual Property

All content, software, trademarks, and materials provided through the Service are owned by or licensed to Skillset Solutions FZ LLC. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial educational purposes only. You may not:

• Copy, modify, distribute, or reverse engineer any part of the Service
• Use the Service for commercial purposes without written permission
• Remove any copyright, trademark, or proprietary notices
• Share your account access or redistribute content to third parties

11. Modifications to Terms and Service

We reserve the right to modify these Terms at any time. Material changes will be notified via email at least 30 days before taking effect. Continued use of the Service after modifications constitutes acceptance of the new Terms.

We also reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without liability to you.

12. Termination

Either party may terminate your subscription at any time. We may immediately suspend or terminate your access if you breach these Terms. Upon termination:

• Your access to the Service will be revoked
• You remain liable for all fees incurred through the end of the billing period
• No refunds will be provided for unused time
• Sections of these Terms that by their nature should survive termination will continue to apply

13. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. It affects your legal rights, including your right to file a lawsuit in court.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

• Arbitration shall be conducted by a single arbitrator
• The arbitration shall take place in the United States
• Each party shall bear its own costs and fees
• The arbitrator's decision shall be final and binding
• You waive any right to a jury trial or to participate in a class action

Notwithstanding the above, either party may seek injunctive or equitable relief in court to protect intellectual property rights or confidential information.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any action not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of such courts.

15. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

No waiver of any breach of these Terms shall be deemed a waiver of any other breach. Failure to enforce any provision shall not constitute a waiver of that provision.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Skillset Solutions FZ LLC regarding the Service and supersede all prior agreements and understandings.
